TERMS AND CONDITIONS

Part-146 Approval: This mediation training is approved by the New York State Unified Court System’s Office of ADR Programs under Part-146. Final placement on any court roster is at the discretion of the local Administrative Judge, and participation in a course does not guarantee placement on a local court roster. Some courts may require additional training and experience beyond Part-146’s requirements. Acceptance on court rosters may depend on a court’s need for mediators at any given time and may include a particular court’s need for mediators with specific case-type training or experience.
Technical Requirements:Â Trainees are expected to have access to their own device with internet access, broadband connection, speakers, a microphone, and a working webcam or HD webcam. Students are expected to be able to access and use Zoom at a basic level, with video and audio turned on at all times.
Access: Access to the initial training modules is available immediately upon registration and payment. Access to the 40-hour interactive live mediation skills training will be available to trainees who have completed the modules, with classes filled on a rolling basis pursuant to the live-training calendar. There is a limit of 24 seats for each training cohort, which are assigned as trainees complete their pre-work. If all 24 seats are assigned, trainees completing their pre-work will be put on a waiting list in the event of a cancellation and given preference to attend the next live cohort of their choice if no seats become available. Â
Attendance: All trainees are expected to attend and actively participate in all instructor-led live sessions, and must have their cameras on during each session. If a student misses a session, they can continue attending the other sessions but will be required to make up any missed sessions the next time the live program is offered in order to graduate, unless separate arrangements are made with the trainer to make up the lesson content missed.
Â
Refund Policy: Â If a student has registered for a training course and is unable to attend for any reason (illness, work, family commitments, etc.), a refund or rollover request must be submitted in writing via email to [email protected] by the applicable deadline below:
WITHIN 5 DAYS AFTER INITIAL REGISTRATION BUT NO LESS THAN 30 DAYS PRIOR TO THE FIRST DAY OF CLASS:Â If a written refund request is received within 5 calendar days of the original date of registration for the class, a fully paying student may receive a change-of-mind refund for the amount paid, minus a $100 administration and handling fee.
REFUND 60 DAYS PRIOR TO FIRST DAY OF CLASS:Â If a written refund request is received 60 days or more prior to the first day of class, and the student HAS NOT accessed the initial training modules, a fully paying student may receive a refund of all fees paid, minus a $275 non-refundable deposit.
REFUND MORE THAN 30 DAYS PRIOR TO FIRST DAY OF CLASS AND LESS THAN 60 DAYS:Â If a written refund request is received less than 60 days but more than 30 days prior to the first day of class, a fully paying student may receive a refund of 50% of the fees paid, inclusive of the $275 non-refundable deposit.
NO REFUND WITHIN 30 DAYS OF CLASS:Â If a written cancellation request is received within 30 days of the first day of class, or if the student withdraws during the training, there will be no refund of fees paid. However, the student may complete the same training within 365 days of the original enrollment date.
ROLLOVERS: If no written refund request is received by the applicable refund deadline, the student’s registration will automatically transfer to the next available offering of the training. The student will have 365 days from the original enrollment date to complete the training. Any unused fees or credits remaining after 365 days will be forfeited. A student may also request a rollover with the same conditions.

Rescheduling: PeaceChord LLC reserves the right to reschedule a live training to meet the minimum number of trainees required in order to have a dynamic training experience, or for any other emergency reason, with 14 days’ notice to registered trainees.
Videos and Handouts: Trainees will have access to their training portal, training modules and printed materials, for a period of one year after the date of their registration and payment. Trainees are encouraged to refer to the training materials in their portal and rewatch the videos as often as desired.
Release of Liability: This training is a first step toward becoming a divorce mediator. Information shared is for educational purposes and not to be considered specific recommendations for any real-world case. Trainees will be given comprehensive information and will be trained on best practices. However, as with any profession, proficiency comes with ongoing learning and experience. Trainees will not hold the Council and/or its trainers liable for any errors or omissions they make mediating real-world divorce cases.
Certificate of Completion: A certificate of completion will be provided upon a trainee’s successful completion of the training.
